1 DEFINITIONS:

Buyer: The individual purchasing or commissioning an artwork.
Seller: Roberta Prati, the artist offering artwork for sale.​

2. PRICE AND PAYMENT

2.1 Prices are listed in Pound Sterling (£) unless otherwise stated.

2.2 For commissioned artworks, a non-refundable deposit of at least 50% is required once the commission is agreed.

2.3 The remaining balance must be paid before the artwork is shipped.

2.4 Accepted payment methods may include bank transfer or platform-based payments (such as Etsy), depending on the order type.

2.5 If payment is not received within the agreed timeframe, I reserve the right to cancel the commission. In such cases, the deposit will not be refunded.

3 SHIPPING:

3.1 Shipping methods, delivery times, and responsibilities are outlined in the Shipping & Delivery section of this website and form part of these Terms.

3.2 The Buyer is responsible for providing an accurate delivery address. I am not responsible for delivery issues caused by incorrect or incomplete address information.

4. COPYRIGHT / INTELLECTUAL PROPERTY:

4.1 All artworks remain the intellectual property of the Seller.

4.2 The Buyer is granted a licence for personal use only. The artwork may not be reproduced, resold, altered, or used commercially without prior written permission.

4.3 Any commercial use requires explicit written agreement and may involve additional fees.

4.4 Where artwork is shared publicly, appropriate credit to the artist is required.

4.5 Copyright ownership is not transferred unless expressly agreed in writing.

4.6 The Seller reserves the right to display commissioned artworks online and in portfolios, unless otherwise agreed in advance (e.g. gifts or private commissions).

4.7 The Buyer may not modify, alter, edit, or create derivative works from the artwork without prior written permission from the Seller.​

5. CANCELLATION & REFUNDS:

5.1 Commissioned artworks are custom-made. Once work has begun, deposits are non-refundable.

5.2 If the Buyer cancels the commission after work has started, no refund of the deposit will be issued.

5.3 If the Seller is unable to complete the commission due to unforeseen circumstances, a full refund, including the deposit, will be issued.

5.4 If significant delays occur and the commission cannot be completed within a revised and agreed timeframe, a partial refund may be offered, depending on the stage of completion.

5.5 Once the final artwork has been approved and delivered, refunds or changes are not available.

5.6 The Seller reserves the right to terminate a commission if communication becomes abusive, threatening, or persistently disrespectful. In such cases, refunds are not guaranteed and will be assessed based on the stage of the work.
